These Terms of Service ("Terms") govern your access to and use of the website located at hertechacademy.com, our funnels, application and booking forms, programs, and any related services (collectively, the "Services") operated by Kreatif Labs, a registered Ontario, Canada sole proprietorship doing business as Her Tech Academy ("Her Tech Academy," "we," "us," or "our").

By accessing or using the Services, submitting an application or form, or communicating with us, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, please do not use the Services.

1. Eligibility

You must be at least 18 years old and able to form a legally binding contract to use the Services or enroll in any program. By using the Services, you represent that the information you provide is accurate and complete and that you will keep it up to date.

2. Our Services

Her Tech Academy provides paid educational programs, coaching, resources, and community access designed to help women build skills for careers and freelancing in tech. Program details, curriculum, duration, and deliverables are described at the time of enrollment. We may update, improve, or change the content and structure of our programs to keep them relevant.

The Services are provided for educational and informational purposes. We do not guarantee any specific income, job placement, client, or business result. Your outcomes depend on your own effort, circumstances, and other factors outside our control.

3. Applications and Booking

Some Services require you to submit an application or book a call. Submitting an application or booking does not guarantee acceptance into a program. We reserve the right to accept or decline any applicant at our discretion. When you submit a form, you agree that we and our team may contact you about your application, appointment, and enrollment using the contact details you provide.

4. Payments, Fees, and Refunds

Certain programs are paid. Prices, payment schedules, and any payment plans are presented before you enroll. By enrolling, you agree to pay all applicable fees.

Specific payment, cancellation, and refund terms for a paid program are set out in the separate participation agreement or enrollment agreement you sign for that program, which governs in the event of any conflict with these Terms. Unless a written agreement states otherwise, fees are non-refundable once a program has begun. You are responsible for any taxes that apply to your purchase.

If you enter a payment plan, you authorize us and our payment processors to charge the agreed amounts on the agreed schedule until paid in full. Failure to complete payments may result in suspension of access to the Services.

5. Electronic Communications and SMS Consent

By providing your email address or mobile phone number and opting in, you consent to receive communications from us electronically, including by email and text message, and you agree that these electronic communications satisfy any legal requirement that communications be in writing.

Text messaging. If you check our SMS consent box and provide your mobile number, you agree to receive recurring conversational and promotional text messages from Her Tech Academy at the number provided, including appointment confirmations, scheduling and reminders, and service and enrollment notices.

Consent to receive texts is not a condition of any purchase.

Message frequency varies. Message and data rates may apply.

Reply STOP at any time to unsubscribe. After you reply STOP, we will send one confirmation message and will not send further texts unless you opt in again.

We do not share your mobile information or SMS opt-in consent with third parties or affiliates for marketing or promotional purposes. See our Privacy Policy for details.

Carriers are not liable for delayed or undelivered messages.

6. Acceptable Use

You agree not to:

Use the Services for any unlawful, harmful, or fraudulent purpose.

Share, resell, copy, or distribute program content, materials, or community access without our written permission.

Attempt to gain unauthorized access to the Services, other accounts, or our systems.

Harass, abuse, or harm other participants, our team, or any third party.

Upload or transmit viruses, malicious code, or spam.

We may suspend or terminate your access if you violate these Terms.

7. Intellectual Property

All content provided through the Services, including course materials, videos, text, graphics, logos, and the Her Tech Academy and Kreatif Labs names and brands, is owned by or licensed to us and is protected by intellectual property laws. We grant you a limited, personal, non-transferable, non-exclusive license to access and use program materials for your own individual learning during your enrollment. You may not reproduce, distribute, publicly display, or create derivative works from our content without our prior written consent.

8. User Content

If you submit content to us or within our community (such as messages, posts, or feedback), you retain ownership of it but grant us a non-exclusive, royalty-free license to use it in connection with operating and improving the Services. You are responsible for the content you submit and represent that you have the right to share it.

9. Confidentiality and Community Conduct

Information shared by other participants within our programs or community is intended for that community. You agree to keep other participants' personal information and shared experiences confidential and to treat all members with respect.

10. Third-Party Services and Links

The Services may link to or rely on third-party tools and websites, such as scheduling, payment, e-signature, and messaging providers. We are not responsible for the content, policies, or practices of third parties. Your use of third-party services is governed by their terms.

11. Disclaimers

The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure, or that any particular result will be achieved.

12. Limitation of Liability

To the fullest extent permitted by law, Her Tech Academy and Kreatif Labs, and our owner, contractors, and affiliates, will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising from or related to your use of the Services. Our total liability for any claim relating to the Services will not exceed the amount you paid to us for the specific program giving rise to the claim in the twelve months before the claim.

13. Indemnification

You agree to indemnify and hold harmless Her Tech Academy, Kreatif Labs, and our owner and contractors from any claims, damages, losses, or expenses, including reasonable legal fees, arising from your use of the Services, your violation of these Terms, or your violation of any law or third-party right.

14. Termination

We may suspend or terminate your access to the Services at any time if you breach these Terms or the terms of a program agreement. You may stop using the Services at any time. Provisions that by their nature should survive termination, including intellectual property, disclaimers, limitation of liability, and indemnification, will survive.

15. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the Effective Date above and post the updated Terms. Your continued use of the Services after changes are posted means you accept the updated Terms.

16. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there, without regard to conflict of law rules. You agree that any dispute will be subject to the exclusive jurisdiction of the courts located in Ontario, Canada.
